NOTIFICATION OF REGISTRATION FOR EXCLUSION OF THE CARPE DIEM NORTH BESS 1 (PTY) LTD FACILITY ON PORTION 5 OF FARM VARKENSLAAGTE NO. 119, MERAFONG CITY LOCAL MUNICIPALITY, WEST RAND DISTRICT MUNICIPALITY, GAUTENG.

Department of Forestry, Fisheries and the Environment (DFFE): Integrated Environmental Authorisations (Reference No.: BESS/2024/GP/3)

Notice is hereby given in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998) as amended (NEMA), and the recently adopted Battery Storage Exclusion Norm and Exclusion of Identified Activities Associated with the Development and Expansion of Battery Storage Facilities from the Requirement to obtain an Environmental Authorisation (EA), as per Government Notice No. 4557, published in Gazette No. 50387, 27 March 2024, that the Carpe Diem North BESS 1 (Pty) Ltd Facility has been registered for exclusion from the requirement to obtain an EA.

Your attention is drawn to the fact that an appeal may be lodged against the decision in terms of the National Environmental Management Act, Act No. 107 of 1998 National Appeal Regulations published under Government Notice R993 in Government Gazette No. 38303 dated 08 December 2014 (National Appeal Regulations, 2014), as well as in the Registration Letter from the DFFE, as per download link provided below. The appeal procedure is detailed in Chapter 2 Section 4 of the National Appeal Regulations, 2014 and summarised towards the end of the Registration Letter.

Should any person wish to lodge an appeal against this registration, he/she must submit the appeal to the appeal administrator, and a copy of the appeal to the proponent/applicant, any registered interested and affected party (I&AP), and any organ of state with interest in the matter within 20 days from the date that the notification of the registration was sent to the registered I&APs (i.e., from 15 May 2024).
